The Environment Agency (EA) has warned businesses to ensure they meet their Duty of Care requirements when choosing a contractor to transport and dispose of their waste.

Lesley Robertson, Environmental Crime Team Leader for the EA gave the warning following an investigation into asbestos fly tipping in Essex, Hertfordshire and Kent.  Three men were found guilty and jointly fined over £80,000 after over 70 skips of asbestos waste were discovered at a waste site in Benfleet.

The company claimed to be a specialist asbestos transport and disposal company.  Customers were lead to believe their asbestos waste was being disposed of in line with legislation by forged consignment notes and invoices from a registered landfill site.

Tony Windsor, Managing Director, Windsor Waste Management said: “These are unscrupulous and devious individuals; businesses must ensure they employ fully licenced contractors and obtain complete documentation to avoid falling foul of the law.  Cutting corners and costs just put the public’s health and a business’ reputation at risk.”
